Definitions

  • 1.1. Short-Let: A stay of one (1) day up to and including one (1) month, charged on a nightly or weekly rate.
  • 1.2. Long-Let: A stay of more than one (1) month, charged on a monthly rate and governed by a written tenancy agreement.
  • 1.3. Guest: Any person who occupies the apartment under a confirmed booking, whether as the lead booker or an accompanying occupant.
  • 1.4. Premises: The apartment unit, common areas, and all facilities at Stay Hacienda used by the guest during their stay.

Reservations & Booking

  • 2.1. All bookings must be confirmed in writing via an official booking confirmation issued by Stay Hacienda. Verbal agreements do not constitute a confirmed reservation.
  • 2.2. A valid government-issued photo ID (Ghana Card, passport, or equivalent) is required from the lead guest at the time of booking and upon check-in.
  • 2.3. The lead booker must be 18 years of age or older. Guests under 18 must be accompanied and supervised by a responsible adult at all times.
  • 2.4. Stay Hacienda reserves the right to decline or cancel any booking at its sole discretion, including where information provided is found to be inaccurate or incomplete.
  • 2.5. [Long-Let] Long-let bookings require a signed tenancy agreement before occupancy begins. The agreement will set out the specific terms, monthly rate, and duration of the tenancy.

Payment Policy

  • 3.1. [Short-Let] Full payment for the entire stay is required at the time of booking or upon check-in, whichever is earlier. No accommodation will be provided without payment being received in full.
  • 3.2. [Long-Let] Rent is payable monthly in advance. In line with Ghana's Rent Act 1963 (Act 220), advance rent payments shall not exceed six (6) months. Payment schedules will be specified in the signed tenancy agreement.
  • 3.3. All rates are quoted and payable in Ghana Cedis (GHS) unless otherwise agreed in writing. Where payment is made in a foreign currency, the prevailing exchange rate at the time of payment applies.
  • 3.4. Accepted payment methods include bank transfer, mobile money, and cash. A receipt will be issued for every payment received.
  • 3.5. [Long-Let] Stay Hacienda reserves the right to apply annual rent adjustments with a minimum of 30 days' written notice to the tenant prior to any change taking effect.
  • 3.6. Any outstanding charges — including additional cleaning, damages, utility top-ups, or overstay fees — must be settled in full at or before check-out.

Check-In & Check-Out

  • 4.1. Check-in is from 12:00 PM. Early check-in may be available upon advance request and subject to availability. An additional charge may apply.
  • 4.2. Check-out is by 12:00 PM (noon) . Late check-out may be arranged in advance, subject to availability. An additional charge equivalent to half a night's rate may apply.
  • 4.3. Apartment keys must remain in the guest's possession throughout the stay. Upon check-out, all keys must be returned to Security. A fee will be charged for lost or unreturned keys.
  • 4.4. Guests must leave the apartment in a clean and tidy condition. Excessive mess or waste left upon departure may result in additional cleaning charges.
  • 4.5. [Short-Let] Guests who remain on the premises beyond the agreed check-out time without prior arrangement will be charged an overstay fee equivalent to one full night's rate per additional day or part thereof.

Cancellation & Early Termination

  • 5.1. [Short-Let] Cancellations made more than 48 hours before check-in will receive a full refund of any advance payment.
  • 5.2. [Short-Let] Cancellations made within 48 hours of check-in will incur a cancellation fee equivalent to one (1) night's rate.
  • 5.3. [ [Short-Let] No-shows without prior notice will result in forfeiture of the full payment for the first night of the booking.
  • 5.4. [ [Long-Let] Tenants wishing to end their tenancy early must provide a minimum of [30 days' written notice. Early termination without adequate notice may result in forfeiture of a portion of the security deposit or advance rent held, as stipulated in the tenancy agreement.
  • 5.5. Stay Hacienda reserves the right to terminate any stay immediately and without refund in the event of a serious breach of these Terms & Conditions, including but not limited to property damage, illegal activity, or endangerment of other guests.

Occupancy & Guests

  • 6.1. A maximum of four (4) persons may occupy the apartment at any time, regardless of stay type. Unauthorized additional occupants are strictly prohibited.
  • 6.2. The apartment is for the exclusive residential use of the confirmed guest(s) only. Sub-letting or transferring the booking to another party is not permitted.
  • 6.3. Visitors who are not registered guests may not stay overnight. Daytime visitors are permitted but must be supervised by the registered guest at all times and must not exceed the total occupancy limit.
  • 6.4. Pets are not permitted anywhere on the premises.

Conduct & House Rules

  • 7.1. Guests must conduct themselves respectfully at all times and must not disrupt the comfort, safety, or enjoyment of other residents or neighbours.
  • 7.2. Parties, events, or gatherings beyond the registered occupants are strictly prohibited.
  • 7.3. Excessive noise - including loud music, shouting, or disturbances - is not permitted, particularly between 10:00 PM and 7:00 AM.
  • 7.4. Guests must comply with all applicable Ghanaian laws and regulations at all times. Any illegal activity on the premises will result in immediate termination of the stay and referral to the appropriate authorities.
  • 7.5. Bringing explosives, weapons, inflammable materials, or hazardous chemicals onto the premises is strictly forbidden.

Smoking Policy

  • 8.1. Smoking is strictly prohibited in all indoor areas of the premises, including bedrooms, living areas, bathrooms, and corridors, in accordance with Ghanaian public health law.
  • 8.2. Smoking is only permitted in designated outdoor areas as indicated by Stay Hacienda staff.
  • 8.3. Evidence of indoor smoking will result in a deep-cleaning charge being levied against the guest and deducted from the security deposit.

Property Damage Policy

  • Guests are fully responsible for the condition of the apartment and all its contents throughout their stay. Any damage to the property, fixtures, furniture, fittings, appliances, or inventory - whether caused accidentally or deliberately - will be assessed by Stay Hacienda and the full cost of repair or replacement charged directly to the guest. Stay Hacienda reserves the right to invoice the guest or deduct the applicable amount from the security deposit held. Room inventory - including pillows, blankets, and towels - must not be removed from the apartment. Stay Hacienda accepts no liability for loss of or damage to guests' personal belongings during the stay.

Housekeeping & Utilities

  • 10.1. Complimentary housekeeping is provided once per week for all stays of seven (7) nights or more. Guests must be present during the scheduled cleaning session.
  • 10.2. [Short-Let, under 7 nights] A standard clean is performed at check-out. Mid-stay cleaning may be requested and is charged at GHS 60 per session.
  • 10.3. Additional cleaning beyond the complimentary session may be arranged upon request at GHS 60 per session and will be charged to the guest.
  • 10.4. Any maintenance or repair needs must be reported to the Facilities Manager promptly. Guests must not carry out repairs, alterations, or modifications to the apartment without prior written consent.
  • 10.5. Where the apartment uses a prepaid electricity meter (ECG) , guests are responsible for maintaining adequate credit throughout their stay. Top-up costs are the guest's responsibility unless otherwise agreed in writing.
  • 10.6. Water and other utility charges, where not included in the quoted rate, will be communicated clearly and settled by the guest accordingly.
  • 10.7. Wi-Fi internet is complimentary for all guests. The network password is provided by the Facilities Manager upon check-in.

Safety & Emergency

  • 11.1. In the event of a fire alarm, guests must immediately follow the evacuation instructions displayed on the inside of the main room door.
  • 11.2. Guests must not tamper with, obstruct, or remove any fire safety equipment, including alarms, fire extinguishers, or emergency signage.
  • 11.3. All emergencies, security incidents, or safety concerns must be reported immediately to the on-site Security team or the Facilities Manager.
  • 11.4. Guests with children under 18 are solely responsible for their supervision and safety at all times while on the premises.

Liability & Indemnity

  • 12.1. Stay Hacienda accepts no liability for loss, theft, or damage to guests' personal belongings during their stay. Guests are advised to keep valuables secure.
  • 12.2. Stay Hacienda is not liable for any injury, illness, or loss suffered by a guest arising from their own actions, negligence, or failure to follow these Terms & Conditions or safety guidelines.
  • 12.3. Guests agree to indemnify and hold Stay Hacienda harmless against any claims, costs, losses, or liabilities arising from a breach of these Terms & Conditions.

Privacy & Data

  • 13.1. Guest information collected during booking and check-in is used solely for administering the stay and complying with applicable Ghanaian law.
  • 13.2. Stay Hacienda will not share guest data with third parties except where required by law or with the guest's express written consent.

14

Governing Law & Disputes

  • 14.1. These Terms & Conditions are governed by the laws of the Republic of Ghana, including the Rent Act 1963 (Act 220) and the Land Act 2020 (Act 1036).
  • 14.2. Any dispute arising from a guest's stay that cannot be resolved directly with Stay Hacienda may be referred to the Rent Control Department for mediation.
  • 14.3. Stay Hacienda reserves the right to update these Terms & Conditions at any time. The most current version will apply to all new bookings from the date of publication.
